Last updated: [09-04-2025] By booking a tour with Dolphin Safari Charters (ERTOSA LLC), you agree to the following terms:

1. Bookings & Payments

All bookings are subject to availability and confirmed once payment is received.

Prices are listed in U.S. dollars and may change without prior notice until a booking is confirmed.

2. Cancellations & Refunds

Guest cancellations: Must be made at least 48 hours prior to the Private Charters departure, or 24 hours prior to the Dolphin Watching and Snorkeling tour for a full refund. Late cancellations or no-shows are non-refundable.

Operator cancellations: Tours may be rescheduled or canceled due to weather, mechanical issues, or other safety concerns. If we cancel and cannot reschedule, you will receive a full refund.

3. Weather & Conditions

All tours are weather-dependent. Safety is our top priority, and final decisions are at the captain’s discretion.

Conditions such as wind, tide, or visibility may affect the itinerary (snorkeling, sandbar, etc.).

4. Wildlife Sightings

Dolphin and wildlife sightings are not guaranteed. Our captains will do their best to provide the best experience possible, but these are wild animals in their natural habitat.

5. Guest Responsibilities

Guests must arrive on time at the designated meeting point. Late arrivals may result in shortened tours or cancellations without refund.

Guests must follow all safety instructions provided by the captain and crew.

Alcohol or drug use before or during the tour is not permitted.

6. Liability & Waivers

Participation in tours is at the guest’s own risk.

All guests are required to sign a waiver of liability before boarding.

Dolphin Safari Charters (ERTOSA LLC), its captains, and crew are not responsible for injuries, loss of personal property, or other damages during the tour.

7. Communication

By booking, you agree to receive confirmations and updates electronically (email).

Any changes to these Terms & Conditions will be posted on our website.

8. Governing Law

These Terms & Conditions are governed by the laws of the State of Florida, USA.

Summary: We promise to do our best to give you a safe, fun, and unforgettable Key West experience. In return, we ask for your cooperation with our safety rules, cancellation policy, and respect for nature.
